By accessing or using NADAC Intelligence ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

NADAC Intelligence provides pharmaceutical pricing analytics based on publicly available National Average Drug Acquisition Cost (NADAC) data published by the Centers for Medicare & Medicaid Services (CMS). The Service includes price tracking, trend analysis, manufacturer comparisons, and related features.

3. Not Medical or Financial Advice

The Service is for informational purposes only. Nothing on this site constitutes medical, pharmaceutical, clinical, or financial advice. NADAC prices are survey-based estimates and may not reflect actual acquisition costs at any specific pharmacy, distributor, or institution. Do not make clinical, purchasing, or financial decisions based solely on data presented on this site. Always consult qualified professionals for medical and financial guidance.

4. User Accounts

To access certain features of the Service, you must create an account. You are responsible for:

• Providing accurate and complete registration information
• Maintaining the security of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized use of your account

You may register using an email address and password or through Google OAuth. You must be at least 18 years old to create an account.

5. Subscription Plans and Payment

The Service offers free and paid subscription tiers. Paid subscriptions are processed through Stripe, a third-party payment processor.

• Subscription fees are billed in advance on a monthly or annual basis
• You may cancel your subscription at any time through the billing portal
• Cancellation takes effect at the end of your current billing period
• No refunds are provided for partial billing periods
• We reserve the right to change pricing with reasonable notice

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Scrape, crawl, or use automated means to access the Service beyond normal use
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or its infrastructure

7. Data Accuracy and Limitations

While we strive to provide accurate and timely data, we make no guarantees regarding:

• The accuracy, completeness, or timeliness of NADAC pricing data
• The availability of the Service at any given time
• The correctness of derived analytics such as outlier detection, trend calculations, or price comparisons

NADAC data is sourced from CMS and is updated on a weekly basis. There may be delays between CMS publication and availability on the Service.

8. Intellectual Property

The Service's user interface, design, analytics, derived metrics, and original content are the intellectual property of NADAC Intelligence. The underlying NADAC pricing data is public domain, published by CMS. You may use exported data for your own internal purposes but may not republish or redistribute it in a way that replicates the Service.

9. Limitation of Liability

To the maximum extent permitted by law, NADAC Intelligence and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability for any claim arising from these terms or the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms or for any other reason at our discretion. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately.

12. Changes to Terms

We may update these Terms of Service from time to time. We will notify registered users of material changes via email. Continued use of the Service after changes constitutes acceptance of the updated terms.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.
